Norfolk Sept. 15th 1865
To Asst. Super'dt of Freedman's Bureau

In consideration of the decision made by Col O Brown of Aug 3d 1865. made in reference to my application for restoration of property in Norfolk & Portsmouth; and herewith received; from which it is infered that the property will be restored when it is made to appear "that it was not a case of abandonment" 
And more especially in reference to the provisions of the 6th sect. of Circular of Gen'l O Howard Chief of Bureau, bearing date the 12th Sept. 1865. and deciding; "That property in possession of the Bureau as "abandoned", which does not fall under the definition as abandoned as set forth in Sect 2d of the Act of Congress of July 2d 1864 will be formally surrendered by the Asst. Commissioner of the Bureau for the State upon its appearing that the claimant did not abandon the property in the sense defined in said section & act"
I am encouraged to renew my Former Application and respectfully beg leave to submit to your consideration the accompanying affidavits and proofs, going to show:
1st That the annex of this property was not voluntarily absented; for he had never resided in Norfolk or Portsmouth for Seventy Years.- and
2d  Given extreme age & Bodily infirmity has not been engaged either in arms or otherwise in aiding or encouraging the Rebellion; both of which elements must combine under the decision of the Bureau, to constitute a case of abandonment. All of which is most
