aforesaid, in whose possession, or subject to whose control, they now are.

6. The said owners of the said lots of land have at no time been [[strikethrough]] absent [[/strikethrough]] voluntarily absent therefrom and engaged in arms or otherwise in aiding or encouraging the rebellion, nor have the said lots, nor has either of them, been confiscated, or condemned and sold by decree of the United States Court for this district; nor have the United States acquired title to the said lots, or either of them, by confiscation, sale, or otherwise.

7.Under these circumstances your petitioner prays that the said lots shall be formally surrendered to him, or the administrator of the said William Doyle, dec'd, for the benefit of the owners thereof aforesaid; and that the rents thereof from the time of their occupation by the military authorities as aforesaid till such surrender shall be paid him for the like benefit of the said owners; and your petitioner will even pray &c
