The petition of Thomas S. Herbert of the County of Elizabeth City in the State of Virginia respectfully represents that about the year 1857 Mrs Sarah A. Levine of said County of Elizabeth City departed this life intestate leaving a large real and personal estate in the said County of Elizabeth City and else where among which was the following lots of land in the City of Portsmouth viz: one situated on the South side of King Street, between the property of Michael King's Estate on the East and the property of Cornelius Ironmonger on the west; also another lot situated on the north side of County Street with the tenements therein lying between the property of William Knott on the east and then Levine's on the west. 

All of which said estate passed and descended to your petitioner and to his brother Joseph B Herbert as the only heirs at Law of the said Sarah A. Levine.

Your petitioner further represents that his said brother Joseph B Herbert died August 1865 leaving a widow and two infant children as his heirs at Law; and that the said lots of land with their appurtenances [[strikeout]] which ? firstly to him [[/strikeout]] and his said brothers two little infant children who are entirely dependent in the possession of and held by your Bureau.
