Respectfully returned the applicant has recd a special pardon which I have seen dated Sept 20 1865. He files herewith evidence that decree of confiscation has been dismissed = He desires now to include in his application House No 80 Main Street: - which was moved over to this Bureau by order from War Dept approved by the President.

While I do not [[wish?]] to embarrass this particular case I would respectfully ask for information as to the power of a
Dist Atty to dismiss a decision of confiscation. While the court is not in session - I am informed by competent legal Authority that no right exists - but that either a new trial Must be granted or an appeal taken to a higher Court.  This house was ordered to be sold but the sale was postponed with others -
