otherwise however, if, in, to or out of the same, to have and to hold the said house and lot piece or parcel of land, and every part and parcel thereof with their appurtenances, unto the said William A. Lowell his heirs and assigns forever, and unto the only proper use and behoof of him the said William A. Lowell his heirs and assigns forever. And the said John W. Merwin, for himself, his heirs, executor and administrator, and for and in behalf of the said Maria G. his wife, and his heirs, doth covenant, promise, grant and agree, to and with other said William A. Lowell his heir and assigns, by these presents in manner and firm following to wit: That he the said John W. Merwin and his heirs, the said house and lot, piece or parcel of land and premises, hereby granted or intended to be with the appurtenances, unto the said William A. Lowell his heirs and assigns, against him the said John W. Merwin and his heirs,and against the heirs of the said Maria G. his wife, and against all and every person or persons whatsoever, will warrant and forever defend by these presents: In witness whereof the said parties to these presents, have hereunto signed their name & affixed their seal this day and year first above written.
