herein after named to sell such part of my unimproved lots as may be needful and apply so much as is necessary of the proceeds to that purpose, and distribute the remainder if any as directed in the Seventh clause of this will.

Tenthly I do appoint my beloved wife Mary McPhail to be the sole Executor of this my last Will and Testament and request that no security be required of her and I wish that on appraisement be made of my Estate. In Witness whereof I have hereunto set my hand and affixed my seal this sixteenth day of November in the year of our Lord One thousand Eight hundred and fifty.

This last Will and Testament of John McPhail deceased was proved according to law by the oaths of John. H. Nash and S. P. Pollard two of the subscribing witnesses thereto and ordered to be recorded. And on the motion of Mary McPhail the Executrix therein named who made oath thereto according to law and entered into and acknowledged a bond in the penalty of Fifty thousand dollars without security as directed by the Testator conditioned according
