and payable according to the tenor and effect of this Deed as here in before specified or in the event of the said Henry Fitzgerald failing, neglecting or delaying to pay unto the said John E. Tunis or his assigns, punctually, regularly & semi-annually the interest which shall or may hereafter accrue semi-annually according to the tenor and effect of this Deed either upon the said sum of $1000, herein before stated as payable by said Fitzgerald to said Tunis on the 15th day of June 1861 and bearing interest, which said interest was to be paid semi-annually from the date hereof or upon the other said sum of $1000, hereintofore specified as payable by said Fitzgerald to said Tunis on the 15 day of June 1862 and bearing interest & which said interest was to be paid semi-annually from the date hereof and the balance if any to pay over to said Henry Fitzgerald or his assigns, Witness the following signatures and seals.
