The applicant has received a special pardon, which I have seen, but no evidence has yet been produced that the State Dept has received his acceptance of said pardon. The Property applied for was confiscated and turned over to the Bureau by an order from War Dept. dated July 26 and approved by the President. I have taken the same ground as on Mr Taylors application viz that the decree of confiscation must be dismissed before the Bureau can surrender the property  

I have consulted his Lawyers in this city and find that they both agree with me, and one of them informed me that Judge Underwood had decided that by a decree of Confiscation the United acquired a right to the property which could only be restored by a new trial so long as the decree of confiscation remains
