I would remark in conclusion that Mrs Johns' husband has no interest whatever in the property and that his duties as the Bishop of the Episcopal Church in the diocese of Virginia requiring his residence within that part of Virginia where the chief part of his duties (and to which he has entirely, devoted himself) were to be performed that her duty as wife required her to go wherever her husband went and being in contemplation of law, sub protestate viri, it can not be alleged that she was voluntarily absent from her property and her residence within the Confederate lines ought not and can not justly prejudice her position in regard to the property under any circumstances altho in view of the fact that the property is and always has been legally and actually in my possession and control it is submitted that the fact of her residence is wholly [[strikethrough]] and [[/strikethrough]] immaterial upon the question of my claim for the restoration of the property.
Bishop Johns immediately after the surrender of Genl. Lees' army issued his pastoral address to his diocese recommending his clergy and people to submit in good faith to the Government of the United States. and himself repaired
