This Deed made this 17th day of September 1860 between James E. Barry and Mary M his wife of the one party and John B. Biddle, John J. Francis and F. F. Ferguson Trustees of the Norfolk Building Fund Association of the City of Norfolk of the other party. Whereas the said James E. Barry did on the 13th day of September in the year 1860 receive an advance or loan from the said "The Norfolk Building Fund Association of the sum of twenty one hundred dollars and did execute therefor to the said The Norfolk Building Fund Association his bond of even date herewith in the final sum of forty two hundred dollars with condition in the following words figures to wit: "The condition of the above obligation is such that whereas the above bound James E. Barry is a subscriber for fifteen shares of the stock of the above named The Norfolk Building Fund Association and did on the 13th day of September AD 1860 receive an advance or loan from the said The Norfolk Building Fund Association of the sum of twenty one hundred dollars for the redemption by the said the Norfolk Building Fund Association of his said shares of stock. Now if the said James. E. Barry shall well and truly pay to the said Norfolk Building Fund Association in the manner provided by the constitution and by Laws of the said The Norfolk Building Fund Association or any amendments thereto, all monthly dues on the said fifteen shares of stock redeemed and also the interest monthly at the rate of six per centum per annum upon the said sum of twenty one hundred dollars advanced, and also the fines and charges if any that may be assessed against him the said James. E. Barry on the said fifteen shares redeemed: then the above obligation shall be void, but otherwise it shall remain in full force and
