Respty returned to Bvt Brig Genl O Brown with the information that part of my property has already been turned over to Capt Geo. Q. White
My means of transportation has been ready to transfer since the date of the order authorizing the transfer. I did refuse last evening to turn it over for the reason that he told one he should take it away from the place where it is now kept. and put it in his own stables.
This would necessitate me making a request upon him for the Ambulance and would delay the work which was required to be done early this morning. Therefore under the circumstances I refused to make the transfer until I had seen you respecting the matter.

Respty returned. There is no Physician, as I believed at Lynchburg, who can take the required oath. Some Medical Officer must be responsible for the considerable amount of Hospital property at Lynchburg, and take the general charge of drawing rations. appropriating the Hospital Fund &c &c
I do not consider it compatible with the interests of the Bureau to make the arrangement proposed within at the present time. 
Capt Lacy has constantly certified to the efficiency of A.A. Surg Kempton. If not efficient and capable the fact should have been reported and some other Medical Officer would have been assigned to his place. 
If there has been any irregularity in regard to purchases with the Hospital Fund, the Supt who is the issueing C.S. should have known that all was correct. By the regulations the coming Subsistence is supposed to make the purchases with this fund and the entire control is in his hands. 
If Capt Lacy, as seems to be suggested, thinks that there is improper use made of these purchases- he should in the first place restrict them within proper limits -and in the second place report any facts he may have in regard to such misappropriation- The matter would then receive prompt attention. 
Under the circumstances until Capt Lacy reports to this office more fully in regard to these matters. I advise him to insist that all relations between the Hospital and the private msgs of the Surgeon in charge shall immediately cease. Capt Lacy may be assured that if he has any reliable facts to show misappropriation of Hospital resources, on their being presented to me, not only will Dr. Kempton be relieved. and another Surgeon placed there but charges will be promptly made against Dr. Kempton. 
It is my full determination that the patients. and not Medical Officers, shall have the benefit of extra diet purchased for Hospitals.
