Respectfully returned to Lieut W.F. DeKnight (thru Capt R S Lacy Supt 7th Dist) with the following instructions.
1st It is considered to be the construction of the law that both parents should be colored.
2d The intent of the act is that the children should be the offspring of cohabitation, not casual connection but the father is made the only judge of those children whom he choses to recognize and his recognition or refusal virtually decided the question of cohabitation.
3d. The presence or residence of the children does not affect the legality or propriety of recognition by the father, only renders description more difficult such children should be registered and identified as well as possible.
4th The age of the child is unimportant. adults even when themselves parents should be registered when recognized as legitimate.
5th & 6th To prevent confusion, the legitimatized offspring should be urged to adopt the fathers surname but when from the reasons assigned they do not do so they may be registered with the name now borne. It is more a matter of convenience than of positive requirement.
