The man had before been suspected of, and duly warned against this course; and it was now deemed expedient that he should be subjected to some just and exemplary punishment. In furtherance of this laudable end, I referred the Plantif [[Plaintiff]] to John I Saunders Esqr, J. P., whose attention I called to the late Act of the Genl. Assembly of Va., bearing on the matter, as published in Circular No 11, C.S. B. R. F. & A. L., Hd. Qtr Asst Com. State of Va. This magistrate, however, I have since learned, on consulting with the Attorney for the Commonwealth, decided that the offense was entirely beyond his jurisdiction, and that he had not even authority to recognize the accused to appear before the Grand Jury, by which he would have to be presented.
