that I was not notified of and I find upon examination that he was convicted upon circumstantial evidence - which was very strong - and was sentenced to the Penitentiary and I further find that the Freedman needed one witness who was a citizen of another state and that it was out of the jurisdiction of the court to obtain him and under these circumstances the attorney for the Freedman succeeded in getting the sentence of the court suspended untill he could lay the case before the supreme court of the state for the purpose of getting a new trial granted and although I was not present at the trial I see nothing to induce me to think or believe but that he had all the priviledges that the law allowed him  his attorney had the priviledge of choosing the jury before whome he was tried and other like forms.
