The evidence for the Commonwealth want to show, conclusively that one Hay. lost by Mr Bowls, was found in the possession of Alfred Brown, on Monday the 22nd of Oct. 66. Although Mr John G. Smith, a resident of Winchester, and witness for the Commonwealth, and who is Browns Landlord, Brown living in the rear of Mr. Smiths residence, testified that he saw the Hay in Browns yard, about such on Saturday, the 20th of Oct 66, and that Brown told him, that he had bought it from a white man, who had just brought it there,
Jacob, [[?]] (Freedman) of Winchester, another witness for the Commonwealth, testified that on Saturday night the 20th of Oct 66,  he saw Brown, & Rolls, driving (2)two Hay and cursing another, into the alley leading to where they lived, that it was about one [[?]] at night, when he saw them, he could not see their faces, but knew them by their walk. He ([[?]]) admitted on a cross examination, that he had told others, since Brown was arrested, that the reason why he had - had Brown arrested, was because Brown had been a witness against him, for stealing a [[?]] of [[?]] of Mr. Goldhine.
Mr. Goldhine of Winchester was then introduced by the [[?]], and said that Jacob [[?]] (Freedman) was a thief, that he knew him, and that he was a bad Christian, and wanted not [[?]] him under oath.
It was frown by the defense, & Emmy[[?]], Walker, [[?]], [[?]], (Freedmen) and other witnesses, that the Hay which was found in Brown's possession, was brought to him by a White man,
