affect that a Justice of the Peace or other authority vested with the power of attaining or regulating the institution of criminal proceedings has refused justice to a colored person by improperly neglecting a complaint, or declining to received one with as sworn informations. tendered by such person. whereby a trial as prosecutioner,  might be prevented through partiality or prejudice.
I am of the opinion. that this is attributable to the fact that in turning over cases,. to the Magistrate for trial as adjudicationer I do not send any cases to those who in my opinion are influenced by prejudice against the race, or who are in every degree operated upon by public sentiment .
