In the case of the Boy Othello, it was proved by the witnesses for the defence, that he did not discharge his Pistol until Mr Preston had taken dead aim upon him with his Revolver, and by for the snapping of a cap, would have fired the first shot. Mr Preston stated that he did not snap the cap, but simply raished[[?]] his piece, in the position to fire, cocking it at the same time. They were however released from confinement, on giving bail to the sum of one hundred dollars each, for their appearance at the March term of the Montgomery County Court, which convenes on the first Monday in the Month.
