I have the honor to report, That on 1st Feb, a Freedman named Fitzgerald was severely beaten by a Mr. Lacy at Burkeville Va. I went to two Magistrates and requested them to hear the case. They done so and after hearing the evidence for the prosecution and defense, but without hearing the evidence of the complainant Fitzgerald at all, they decided to dismiss the complaint with costs of $2.00 to the Freedman which they compelled him to pay. I informed them of their neglect in omitting the testimony of the complainant and that I considered it the most important of any evidence they could receive. They said "it wasn't necessary to hear it," they know how the case was. The names of those Officials are Mr. Royal and Hardaway.
