Captain. 
In compliance with Circular No. 10 Par. 7. Hd qurs. Assistant Commissioner State of Virginia dated March 12th 1866 I have the honor to report, that at the regular session of the Circuit Court for this county held at the Court House on the 21st inst. Robert Kempt and four other freedmen were arraigned for trial charged with the murder of a white citizen named Wootten.

After the finding of a true bill of indictment against the prisoners by the grand jury it was found to be impossible to proceed with the trial as a sufficient number of Jurors could not be obtained in the county. 

The case was therefore defered, and will be
