I have the honor to state that a Freedman of Nottoway Co, Va., named Richard Fitzgerald, has applied to the Asst. Sup'dt, and requested that he may be permitted to bring his complaint for Assault & Battery, against Mr. James Lacey, before a Military Tribunal or Commission for trial.  He charges Lacy with an unprovoked and severe assault upon him on 28 Jany 1867, and that although the Circuit Court of this County have heard the case, that justice has not been done him, nor has the law been enforced.  In this, I share his opinions, and would recomend that the case be brought before a Military Court for a hearing, believing that the offence can be established by sufficient evidence.  The Commonwealth's Attorney having since admitted that the trial was unfair and that the law was not enforced.
