that she was thrown down by the Prisoner Mr Dyson and that he committed a rape upon her that she resisted and done all in her power to prevent it, but was unable to do so. Her sister Patsey Vaughan was then [[sworn]], she testified she seen Mr Dyson lying upon the person of her sister, who was struggling and shouting, but could not get away from the prisoner, in fact the entire case was so clear and the guilt of the prisoner so evident that the Asst Suprd't was confident that the offender would be imprisoned. The case was continued one week, and on April 9th was again opened, this time for the defense, who could not offer any rebutting testimony to the evidence for the prosecution, but introduced witnesses to prove his former good character. This was all that was proven and the County acquitted him and dismissed the case.

In order to show feelings and intentions of the Court I consider it proper that I should mention that when the prisoner was first brought into the court room the court upon the motion of the prisoner's counsel, admitted him to bail without any examination or enquiry into the case.
