A man was tried in the Essex County Court a few days since for stealing or rather assisting in stealing fourteen bushels of corn, he was convicted and sentenced to five years imprisonment in the Penitentiary. I consider it very unjust to imprison him for so long a term, although he was guilty and should be punished, but he is a good man and doubtless would never have committed the crime had he not been led into it by another man. A petition is being gotten up by his lawyer to have his term of imprisonment shortened.

When a white person commits an assault upon another white person he is presented by the Grand Jury without fail; but in no instance has a white person been presented for committing the same crime upon a Freed person unless I went to the commonwealth Att'y. and threatened to report it; and in one instance the Grand Jury failed to take notice of a case after the Commonwealth Att'y. had sent the plaintiffs before them; this was two months ago; a few days since I told the Com'th Att'y. that this white man must be presented for striking the
