charged with burning a tobacco house, with tobacco therein of the value of $400. Found Guilty by the Jury, and term of imprisonment assessed at three years - Verdict set aside by the Court, and a new trial granted, and prisoner bailed until next term, in sum of $200.

This action on the part of the Court, in compliance with the request of Prisoner's counsel, I deem only just and fair; as in the first place, the evidence adduced, in my opinion, did not warrant a conviction at all, and, in the second place, the Judge acknowledged that he had admitted some certain testimony which he should not.- This case has been several times referred to by me before, as it came up before the minor tribunals. 

Same, vs. James Preston - charged with stealing a Horse - Verdict of not Guilty, and acquitted.

It may be remembered that, as per my previous Reports, this man was pursued, and when discovered shot at and wounded, although up to that time there was not the least proof that he had ever seen the horse. His case having come up for hearing before the County Court in March, on the 5th of that month I had the honor to submit a special Report in his behalf, in which I stated, that, from the evidence adduced, it was my belief that he ought to have been discharged, and not, as he had been, sent on, since he could not justly be convicted of the alleged felony.

The trial of "John Hudson" for shooting him (the case having been literally forced into court) is now pending, and will come up before the Circuit Court of Roanoke Co. in August. By my advice "Preston" has provided himself with a copy of the proceedings against him, and the verdict of his acquittal, in this Court, to be used in that instance.
