In the case of the Commonwealth vs Waugh. for whom you are asked to interfere I beg leave to state on my own responsibility that it is, one eminently calling; for executive interference - And that out of. five members of the bar, who heard the testimony (with but one exception) all concur with me in saying there is not sufficient evidence, to warrant the finding of the Jury- And that they or some of them, are ashamed of their verdict. The accused was found (in the) no on, the bed, of the prosecutrix sound a sleep in the house of Robertson, the employer of both; one the cook, and in daily association, which the. prisoner. whilst he was the hand, or one of them, who took their meals in the Kitchen; The intention, of the party must be infered from his conduct, and that he intends, to do, that which he does or that which, is the natural consequences of his acts, in some cases; where intention is the gist of the offence; &c. There is no evidence that the accused, was prevented from doing whats charged against; every opportunity was afforded - is he not entitled to the opposite inference - that he had no such intent
