On Monday the 19th day of August the Grand jury made a presentment, in these words, to wit:

Virginia,
Culpeper County, to wit:
In the county court of said county. 
The jurors of the commonwealth of Virginia, in and for the body of the county of Culpeper, and now attending said court, upon their oath present, that Wm Waugh on the 4th day of July in the year one thousand eight hundred and sixty seven, in the night time of that day, did feloniously and burglariously break and enter the dwelling house of Powatan Robertson, in the said county, with intent then and there, in the said dwelling house, feloniously and carnally to know one, Lena Kloss, a female of the age of twelve years, or more, by force and against her will, against the peace and dignity of commonwealth of Virginia.
