Culpeper, broke and entered the dwelling-house of Powatan Robertson situated in the said County; that the prisoner was found asleep on the bed of Lena Klop, a white female between the age of 13 and 14 years, a servant in the employment of Powatan Robertson; that the said Lena Klop was awakened from her sleep by the snoring of the prisoner, and the blowing in of the winds thro' a window immediately over her bed, the sash of which had been hoisted by the prisoner, and propped and kept hoisted by the prisoner a shingle, placed under it by the prisoner; that when Lena Klop awoke she found the prisoner in her bed, but did not know who it was; that as soon as she discovered him, she went from her room on the lower story of the house to an upper story, in which Powatan Robertson lodged with his wife; she went to Robertson's room about twelve oclock at night in great agitation and alarm, and informed him that some body was in her bed- That Powatan Robertson found the prisoner asleep in the bed, awoke him; that the prisoner, when he was first awakened, said, he did not know where he was, or how he got into the room- That all the doors and windows leading out of the room were closed and fastened except the window first mentioned, which was situated immediately over the bed of Lena Klop, and about five feet from the surface of the earth- That the prisoner had a lodging provided-for being [[strikethrough]] over [[/strikethrough]] a room
