over the Kitchen an out house not attached to the dwelling: that the prisoner knew where the Chambers of Lena Klop were Situated in the house: that the prisoner afterwards gave a different & inconsistent account of himself as to how he happened to be in the room of Lena Klop, that the prisoner was a Colored man about 18 years of age & was employed by the said Robertson to work on his farm - that Lena Klop sometimes met with the prisoner in the Kitchen together with two other servants & employees of the s'd Robertson & did some part of the Cooking for Robertsons family: and these were all the facts proved in the Cause, and there upon the Jury found a verdict in these words & figures following to wit: We the Jury find the prisoner guilty & ascertain the term of his imprisonment in the penitentiary to be ten years - And the prisoner by his Counsel moved the Court to set aside the said Verdict & grant him a new trial - upon the ground that the Verdict was contrary to the law & the evidence which motion the Court overruled & refused to set aside the Verdict & grant a trial, to which ruling & refusal of the Court the prisoner by his Counsel excepts & prays that this his bill of exceptions be signed, sealed & enrolled which is accordingly done
