General
In compliance with Cir No 10. Series 1866 I have the honor to report that but one Case of partiality in Cases where colored persons were interested parties have been reported during the month. This was a Case in which Martha Cannon, complained of George and Felix Buchannon, committing a rape. It was examined by two Magistrates in Smythe County and the complaint dismissed for want of sufficient testimony to sustain the charge. Complaints were forwarded to Military Hd. Qrs of an improper trial and requesting a reexamination by a Military Commissioner. At the reexamination before a Mil. Comr. the evidence was not found to be sufficient to sustain the charge of a rape and so reported.

Improper remarks and a lack of order was shown by the evidence at the reexamination.

The case was dismissed by order of the Bvt Maj Genl. Com'dg Sub. Dist. of Lynchburg
