The case of Alfred Huggins Colored vs James L Bain White for shooting - before Justices Charlton & Walters of Montgomery County Va. on the 9th day of November 1867.

The following witnesses were introduced by said Huggins

Robert D Jones "Col'd." Previous to the difficulty and about dusk, Huggins was at witness' house. Huggins started off in the direction of his own house- Witness was eating some apples and said I am eating my supper, and asked Huggins in a joke, if he was going to get his supper. Huggins then went into Bain's Orchard which adjoins the yard of Bain. The difficulty grew out of Huggins taking Bain's apples. I knew that Bain had given orders that none of the apples should be taken from the trees & this order was known as early as July. Huggins knew it, for he told me that Bain had told him, that he and his family might eat the apples that fell off of the trees, but were forbidden to knock any off. I knew of Huggins plucking apples off of the trees, once or twice, after the order had been given. Huggins told me the difficulty occurred first about the middle of the orchard, and I knew it must have been there that he got the apples from the size of apples he had. He also said he had his Pocket Knife open in his hand at the time. I knew it to be but a very small pen knife.
