On a search being made some of the articles were found in Huggins house. The direction of Huggins house from the middle of the orchard, would have taken him a way from Bain's house, in the opposite direction nearly. Huggins had not however received instructions from me for the next day's labor, and would have had to consult with me either that night, or very early next morning. He was also accustomed repeatedly to take supper with me. After the difficulty I told Huggins that I had heard he had said to Bain "that he knocked down no more apples, than he picked up." Huggins did not inform me, whether he had or had not made such a statement.

Margaret Jones (wife of previous witness) 
Did not see the difficulty. Heard Bain tell Huggins to go out of the orchard. He repeated it three times. Huggins made some reply, but witness could not hear what he said. This occurred nearer to Mr. Bain's house than the middle of the orchard. Bain then said D--m you if you don't go out, I will shoot you, and ran to the house. It was no time until I heard the gun go off. Before this I heard angry words between them- they were quarrelling in the orchard. Bain said during the quarrel, "he would cut his head off with the corn cutter. The shooting occurred nearer Bain's house, than the point where I first heard them quarrelling.
