The piece was a flint rifle.

Bain started for more ammunition, said he would put another shot in me - did not threaten me if I did not come out, that he would put another shot in me. The piece was loaded with squirrel shot. I was hired by Robert James to cultivate some parts of the crop, but he had nothing to do with the orchard and no right to the fruit. I had previously worked for Dr. J.B. Radford, Mr B. Wygall, Col J.J. Wade, Musgrove Stone and others of Montgomery County Va. 

James L Bain - Jones and Wiggins were cultivating corn & tobacco on my land. At the time referred to, in the foregoing evidence (in June or July) Alfred was at the shop- When I asked him, why he was not in the tobacco. He said, he went according to the man who employed him and he said he intended to have one of my horses next Monday. Spoke rudely and in a dictatorial manner. I told him, he could not get it- he said he would have it. I told him to go away and give me no more of his jaw, and that I would see Jones about the horse- He then went away muttering something. A young man by the name of Bolling, who was tending a crop on my brother's land, said to me one day "Your apples are going very fast"! I said the negroes will have them all directly if they keep on. I told him, I had given orders on the subject and did not know how to stop them.
