with power to institute or regulate proceedings in such cases either by the refusal of said authority to receive a sworn statement or by neglecting to examine into or adjudicate cases brought to their notice in which Freedmen appeared as parties to the action.

I am of opinion however that this state of things as a general thing is not attributable to a disposition over the part of the whites to do the Freedmen justice but to the simple fact that the adjudication of such cases is confined as far as it is possible to those Magistrates who in my judgment are earnestly and conscientiously endeavoring to discharge their duties faithfully and independent of prejudices and public sentiment. I have instructed all of my subordinate officers to persist in the same policy.
