In compliance with Circular No 10 Series 1866 I have the honor to report that in the case of the Commonwealth VS John Payne & others for Assault & Battery with intent to kill (reported at the time) committed upon the person of Albert Davis (Colored) that the Examining Magistrate placed the bail bonds of these parties at only fifty (50) dollars while the man Davis lay at the point of death. These parties have been indicted before the grand jury but no process has been issued for their arrest. Davis by having good care has so far recovered as to be able to do light work The case will no doubt come up in the next term of the county court
I have no other cases when the criminal courts have failed to deal justly with Freedmen during the past month
