Please furnish this office with a statement of the action taken against the men Payne for the assault on the man Davis, and have the parties secured by recognizance or otherwise, as may be necessary to secure their appearance at court to answer the charge, holding the case open to await the result of the injuries of the man Davis, and report your action to this office.
