Dear Sir
   Absence from home has prevented an earlier reply to yours of the 6th inst.
   The man Payne appeared at our last court in obedience to their recognizance entered into before a Justice, to answer an Indictment to be found by the Grand Jury. The Grand Jury found an Indictment against them for assault and battery. They left without leave of the Court.  The usual process, a summons, (the only process authorized by law) has issued against them to appear and answer said Indictment at the next term, (September) of the Court. I have requested the friends of the boy assaulted to keep me advised of his condition, and as I have heard nothing from them since court, I suppose he is improving. I do not think the recognizance one that will sustain a prosecution for its forfeiture.
