After a short hearing the jury convicted the prisoner and fixed the sentence at five years in the penitentiary. The court refused to grant the motion of the prisoner's counsel for a new trial and refused to remain in session long enough for a Bill of Exception to be prepared, but, much to the amazement of the whole bar, left their seats & went home, refusing to adjourn over or to remain until a statement of the facts proved could be prepared by the counsel.
Every lawyer who witnessed the proceeding expressed astonishment and indignation at the course the Court pursued, and several, among them Mr. Leake & Mr. Guy tendered their assistance to the prisoner's counsel. Mr. Geo. I. Hughes, in procuring a pardon at the hands of the Governor. In my opinion such a pardon should be granted. This is the first case in Goochland County since I have been stationed here, in which I have thought execution clemency to be demanded.
