he also proves that he took the mule to Mr John's and kept it at his own expense, and that when he was turned away from Mr John's he made application for the mule, but Mr John's refused to give it to him. Mr Johns stated that Kendall brought the mule to his place at the time of the surrender and gave it to him. he also produced an order from the Pro Marshal to retain the mule until called for by the U.S. Authorities. Mr Johns is a very wealthy man, while the freedman is poor and supporting an aged mother. 
I would respectfully recommend that the mule be given to the freedman.
