8th Case
(Williams & Wornly vs Sterling)
We turned him out and he stood round and wouldnt eat Sunday morning. In my opinion the horse was diseased when I got him.
Cross Ex by Deft. Where did you hear on Dr Sterling say the horse was sound. Ans.-Heard it in Williamsburg. He spoke it at the auction.
Jesse Williams Sworn
I live on Warren farm York Co. Va. Have lived there the last year. W. Warmly and I bought a horse of Dr. Sterling. Paid 61 dollars. Me and him went halves. I paid 23 dollars that day and he paid the rest. We paid it to a man by the name of Bowden. Wilson cried the horse. 
When they was crying the horse I went round him and I said is he a sound horse! He said he was a sound horse. I touched the horse in the side and he said the horse would work anyhow. Carried the horse home Saturday and he lived 3 days only. He was diseased. He was not sound Sunday. Dr. Sterling said the horse was thin in flesh and what the horse wanted was feed. I carried him to water Sunday morning. When he was drinking, stuff just run out his nose and stunk so bad I could hardly bear to stand near him.
The horse was diseased I think when we got him.

William Hulman Sworn
I live with Dr. Sterling in Williamsburg. Was present when a conversation took place between Wormly & Dr. Sterling on Tuesday I think. I and Dr were together on the road near Warren farms
