Proceedings of the Freedmen’s Court in the County of New Kent, Va.; for the week ending April 7th 1866.

The Court convened at Cumberland, New Kent Co. Va. April 6th 1866.
Present. Capt. N. M. Brooks Asst. Supt.

Thomas Fox vs. Josiah Higgins  
} Action for recovery of a mule, and damages.

The Def't. having been duly notified, failing to appear the case was heard in his absence.

Plaintiff states; in March 1864 Gen. Sheridan’s Forces at the White House seized two of his horses and that he was permitted by Capt. Alderbeck to retain the mule in question as partial indemnification for his loss; he got the mule into working order by July or August /64 when he was claimed and forcibly taken from him by Def't., as a mule lost by himself sometime before; that Deft.’s mule was about 23 yrs. old, the one in question is about 7 yrs. old.

Mr. Hammond Hewlett testified to the truth of above statement; the only point of resemblance in the animals was color; gait of the two entirely different; Deft.’s mule was taken by the Confederates and branded “C.S.” in latter part of /63 or early part of /64. There was
