Oliver Cross vs. George M. Pomfrey } Action for Debt.

Pltf. bought a horse on Apr. 5th/65 of Deft. for $60 on which he paid $30 50/100 and was allowed time for the balance.  Deft. made frequent calls on Pltf. for further payment and in July notified him that he (Deft) would take the horse again, if he (Pltf.) was not ready to pay some on a/c. when he next called.

Pltf. not being able to make any further payment Deft. took the horse; Pltf. brings action to recover the amount paid on the horse.

Decision:  It appearing that Pltf. used the horse in cultivating a crop for himself to his own benefit, and that Deft. lost by the absence of the horse the Court allows Def't. for the use of the horse $15. and orders him to return the balance
