Charge
Default of Payment

Isaac Hill (col'd) being duly sworn deposeth as follows. During the month of January 1866. I sold the late William West. (col'd) Three and one third (3 1/3) barrels of corn at Three (3) Dollars per barrel. West paid me Four (4) Dollars when the corn was delivered, the balance has not yet been paid.

George Sayers (col'd) being duly sworn deposeth as follows  I was present when Isaac Hill delivered the corn to West, Saw the Four (4) Dollars paid, and heard West promise to pay the balance soon, do not know whether it has been paid or not.

David Elliott (col'd) being duly sworn deposeth as follows, I saw the corn delivered by Hill to West did not see any money paid to Hill, heard West say he was to pay Three (3) Dollars per barrel, for the corn.

The Court unanimously decided to give judgement in favour of Plaintiff for amount claimed.
