Y. Baker (white) vs. James Costelow (col'd.)

Charge  Trespass.

Edwin Baker (white) being duly sworn states, I am acting as Agent for Y. Baker I know that the swine belonging to the defendant got into an enclosed lot belonging to Y. Baker, and destroyed seeds to the amt. of Ten dollars.  I made a careful investigation of the damage, immediately after the swine were driven out.  the lot was planted with very valuable seeds.  Potatoes and Corn, there were other hogs in the lot, but do not think they done any damage, it was part of the business to watch this lot. I examined every part of the lot after the other hogs were driven out, and did not see any damage done by them.

James Costelow (cold.) being duly sworn, states, I have seen my pigs, on the lot of Y. Baker, several times, as the fence was not sufficient to keep them out, have four small pigs and one large one, have seen as many as five large hogs on the lot at one time.
