It appears from these 109 papers that no competent order was given for giving the Medical services for discharging which the within bill is presented. It is also stated within that the services were rendered as a matter of humanity without thought of pay. I am not aware that any humane Physician is engaged in the practice of his profession for any length of time without rendering services like these as a matter of humanity -without expecting or ever receiving pay from any source. The very fact as stated within that the services were rendered as an act of humanity without regard & hope of reward brings this case within the class of cases constantly occurring in Med practice. If pay was expected it was certainly not strictly a matter of humanity but of regular business. _ If it was an act of humanity pay could not be expected. I cannot on the statements made in relation to the within account approve its payment and this conviction makes it unnecessary for me to call special attention to the informality of the account.
