Respectfully returned to Bvt Brig Genl. O. Brown, Asst Comr. thro Capt. J.A. McDonnell Supt with the information that the affidavit of Mr. William F. Stolle is substantially correct. That Mr. Maquire did assault him without cause, that Mr. Joseph S. Mitchell (a Justice of the peace was present when it occurred and did not cause the arrest of Mr. Maguire, and no steps whatever has been taken by the civil authorities to bring him to justice. In consideration of which fact and for the better protection of the few Union men of Clark Co would (if I may be allowed) respectfully suggest that Mr. Maguire be tried by a Military Commissioner for the offence committed, that Mr. Joseph S. Mitchell be relieved from his office as a Justice of the Peace, and as Mr. Maguire has been appointed

a Commissioner in chancery, that his appointment be revoked as I think such steps would have a good effect in that action, for I honestly believe that under the present state of things the Union Men of Clark Co. do not stand as good a chance to have justice rendered them as the Freedmen.
In regard to the affidavit of Mr. Boxwell in reference to the threats said to have been made by Mr. Maguire, I could learn nothing definite as there was no one present at the time mentioned, but those that are in sympathy with said Maquire except Mr. Boxwell himself, and they would not give any evidence that would commit him, but the rebels consider (those that I have talked with) consider Mr. Boxwell a man of truth and honesty, and who would not knowingly make any statement that he did not believe to be true.

Maria Commodore thinks he can give some information of his son, Jeremiah who lived with him for a while. Rachael Morgan, Davids mother, deserves to find out what her son is in prison for, and whether any thing can be done for him.
