On a careful examination of these papers it does not appear on what grounds the order for Dr. Gray's discharge from service was based. The inference is that it was because the charges preferred by him against Lt. Col. Chipman were not sustained by the witnesses examined by Lt. Col. George Gibson at the time of his official investigation of the matter. With no design of reflecting or animadverting in any way upon Col. Gibson's course, I feel constrained to say that his investigation appears to have been very limited, and not at all likely to elicit the full, and as Dr. Gray alleges, the strongest proof of the truth of the charges. Justice to Dr. Gray in view of the nature of the charges and the character of the service, would seem to have required that he should have been notified of this extra judicial investigation, or at the least that all or most of the witnesses mentioned by him should have been examined and if this evidence failed to sustain the charges, they would of course fall through and no need would have arisen for the testimony of the friends of the accused party. I know of nothing in the conduct or professional character of Dr. Gray but what is stated in these papers, and they are highly complimentary to both.

Respectfully returned to Maj. Genl. O. O. Howard, Comr. I do not think it would be proper to place A.A. Surg. W.H. Gray on duty again in Va. Genl. Schofield discharged A.A. Surg Gray for reasons that were satisfactory to himself and would I think as Military Commander of the District object to his being placed on duty again within his command. I would respectfully submit whether A.A. Surgeons cannot be discharged without charges being preferred against them!
