Respectfully returned to Bvt. Lt. Col. Geo. Gibson, 11th U.S.I. & pres. of the board for the appointment of Registering officers (thro: Bvt Brig: Genl O. Brown, Asst. Comr) with the following information- About the middle of April last, I was requested by Bvt. Maj; W. H. Brown, 5th U.S. Cav. to recommend Col Russell for appointment, but not being personally acquainted with his political status, I deemed it proper to make some inquiries, and the result convinced me, that as Mr Russell had no sympathy with the efforts the Government was making for the reconstruction of the States lately in rebellion, I could not consistently recommend him_ My conclusions were arrived at from conversations with prominent Union men, who resided here during the war, and others who have been here since its close. Inclosed are the affidavits of two respectable gentlemen, could be multiplied by others to a large amount, which help to establish the political standing of Mr Russell.

Armstrong, with the statement that upon investigation of the within case, I find that this case, has not been tried, and that James Martin was wrongly informed by the constable. Mr. Richard Ayers, never having set upon the case. This case will be tried the 3rd Saturday of June, and James Martin informed me that he thinks that justice will be given to him, when the case is tried.

Redman, I have given the case to the Commonwealths attorney to be brought before the Grand Jury at this May term of the Court. Carter would compromise, but not able to do so for lack of means & I think he will be dealt with as he deserves by this court.
