Respectfully returned to Capt. R.S. Lacey, Agt. in chg. I have heard all the evidence in the case set forth within Wyatt Wheeler did come into possession of the horse and take it to Mr. Cothrane's as set forth in his petition. He swears positively that the agreement was that Mr. J.H. Cothrane was to keep the horse a sufficient time to compensate him for the trouble of recuperating the hors. Mr. J.H. Cothrane is not positive on that point, but don't think he made such a bargian.- On the 16th of April 1865 Mr. Cothrane got an order to: "procure two horses or mules & to have full control over said property unless called for by the U.S. Govt. from whom they have been turned over to me sgd. Wm D. Hix, who was at that time distributing agt. of the U.S. Mr. Cothrane claims this horse under that order. Subsequently Mr. Cothrane got an order from Capt. Grier, P.M. to hold the horse 'till called for by the U.S. This order is dated Nov 9th 1865 The horse was very much reduced when Wyatt, came into possession & was of no service 'till sometime in July 1865, when he was used to plough corn. Mr. Cothrane proved that he sent Wyatt word, that the horse was of no account & to take him away; this was before receiving the order of Hix. I think Wyatt Wheeler is clearly entitled to possession of the horse unless the agreement was violated. 1st by the notice which Cothrane proves he sent Wyatt to take the horse away & which Wyatt persistently denies receiving. 2nd By the order which Cothrane received from Mr Hix to procure two horses (not this particular horse) and unless the services of this horse is not ample compensation for the trouble he gave Mr Cothrane is 1865.
Mr. Cothrane - states not. he also states that the U.S. forces took from him four good horses. I should think that Mr. Cotherane had been fully compensated for his trouble - by the work he has gotten out of this horse up to the present time.
