Respectfully returned to Capt. Wm. P. Austin, S.A.C. enclosing appeal of A.M. Cooper & copies of affidavits & other papers in the case.

I would respectfully state in reference to Mr. Cooper's plea that he could not without inconvenience attend the court as it was held in "Roanoke County" and therefore could not defend himself, that I took this question into consideration & summoned him to appear before me at Craig C.H. & bring his witnesses; that I personally went to Craig. C.H. & examined such witnesses as he produced; that the negro had no advantage over him as to the place of trial or summoning of witnesses.

Mr. Cooper & Jerry Banks appeared before me at Craig. C.H. with their witnesses on the appointed day and the written testimony was submitted to the other judges of the Freedmens Court on my return to Roanoke, Co. I have no recollection of Mr. Cooper claiming at that time to have any other witnesses. 

Mr. Cooper states in his appeal that Jerry Banks character as an industrious man was not such as to entitle him to wages. The statements of many respectable citizens of Crain, Co. along with all that of Mr. Jos. Holt in the enclosed communications, on this point, & the fact that Mr. cooper with two hands (Jerry & Snodgrass) cultivated his farm, raised 1000 bushels of corn, a quantity of oats, wheat, hat &c. show conclusively that Jerry must have done considerable work.
