Brown, Asst. Comr. of Va. I regard the sentence, in a legal point of view as correct as there was no evidence whatever to show who fired first shot beyond mere statement of the prisoner. Patterson gave himself up to me and was at once turned over to the civil authorities. As he had a fair trial it seems unnecessary to take the testimony for Bureau purposes and though I should join in the petition for his pardon yet I do not see how a Jury could acquit unless on the Virginia rule that an accused's statement unsupported as to self defense is sufficient ground of acquittal. It appears from the communication that Carter was hunting for Patterson through the day for the purpose of killing him and that his (Carters) gun was found discharged, one witness testifying that he heard two shots fired.
