Respectfully returned with report, that after a thorough investigation of the within case I find the facts to be as follows. Mr. Wm. Hudgins who formerly owned the boy, removed to Texas before the close of the war, taking the boy with him, where he remained until March 1867 when his father (Moses Nutt) hearing that Mr. Hudgins was to return to this County, wrote to him asking him to bring the boy with him, and stating that he would pay all the expenses of the trip. When the boy arrived, Moses refused to pay his expenses unless he was paid for the time that had elapsed since the fall of Richmond. The evidence at the trial showed that the boy had been hired out for his board for a short time. Mr. H. states that he kept him for the reason that he (the boy) was unable to provide for himself. The boy at this time would probably hire for his board & clothes & ten dollars per year. I have suspended all proceedings in the case until I shall receive orders from the Asst. Comr. of Va.
